Smooche began as a small studio with one mission: to redefine how the world sees cosmetics. These terms protect you, us, and the magic we create.

1. Scope

These Terms of Service apply to all orders placed through smooche.us and any related transactions with Smooche (“we,” “us,” “our”). By placing an order, you (“customer,” “you”) accept these terms.

2. Conclusion of Contract

Products shown online are not a legally binding offer.

When you complete your order, you submit a binding offer to purchase.
We accept your offer when we send you an order confirmation email or when we ship the goods — whichever happens first.

3. Prices & Payment

All prices are in USD and do not include applicable sales tax (tax is calculated at checkout based on your shipping address).

We accept payment methods shown during checkout. Payment is due immediately upon order placement.

4. Delivery

We ship to addresses within the United States (and internationally where available at checkout). Delivery is made to the address you provide.

Estimated delivery times are shown at checkout. We will notify you of any delays.

5. Shipping Costs

Shipping costs are displayed at checkout. For international orders, customs duties, taxes, or import fees are your responsibility.

6. Right to Cancel (30-Day Return Window)

You may cancel your order within 30 days of receiving your item(s) without giving a reason.

To cancel: email support@smooche.us with your order number.

After cancellation we will:

  • Refund the full product price + standard shipping costs

  • Refund within 14 days of receiving the returned goods

Exception for cosmetics (hygiene & safety):
Due to health regulations, we can only accept returns of unused, unopened, and still sealed cosmetics. Opened or tested products cannot be refunded for safety reasons.

7. Return Policy

Returned items must be:

  • Unused

  • In original condition

  • In original packaging (if possible)

You are responsible for return shipping costs unless the item was defective or we made an error.

8. Warranty

We warrant that our products will match their description. Statutory warranty rights under Michigan and US federal law apply.

If a product is defective, you may receive a repair, replacement, or refund according to law.

9. Cosmetic Disclaimer & Liability

Our products are handmade in small batches. Because individual skin chemistry varies, we do not guarantee that any product will be free of allergic reactions.

You agree to:

  • Perform a patch test before full use

  • Discontinue use immediately if irritation occurs

Our liability is limited to:

  • Intentional or grossly negligent acts

  • Personal injury caused by our proven negligence

We are not liable for allergic reactions, sensitivities, or misuse of products.
This does not affect your non-waivable legal rights.

10. Limitation of Liability

To the maximum extent permitted by Michigan law, Smooche is not liable for indirect, incidental, or consequential damages arising from product use.

11. Data Protection

We collect and process your personal data (name, address, email, payment info) to fulfill orders. We do not sell your data.

12. Applicable Law

These Terms are governed by the laws of Michigan and the United States, without regard to conflict-of-law principles.

Any dispute shall be resolved in the courts of Washtenaw County, Michigan.
